1. Acceptance of Terms

By accessing or using eternalgardensreserve.com, or by purchasing a plot, service, or installment plan, you agree to these Terms of Service. If you do not agree, please do not use our services.

2. Services Offered

Cemetery property listings and private resale marketplace
Burial Plot Concierge service (included with every purchase — covered by your down payment)
Installment payment plans with 0% same-as-cash terms if paid in full within 18 months (3.5% APR thereafter)
Deed transfer coordination with the applicable cemetery
Free Planning Guide and Notary Kit & Family Planning resources

3. Payments & Fees

All payments are processed securely via Stripe. A $500 deed transfer fee is paid directly at the time of transfer to the cemetery administration office. Concierge services (verification of ownership, payment coordination, deed-transfer scheduling, document notarization) are included with every purchase and covered by your down payment — no separate fee. The List-Your-Plot listing fee ($149) is disclosed before checkout.

4. Refund & Exchange Policy

All sales are final. No refunds will be issued.

In recognition of the deeply personal nature of these purchases, we offer the following exchange options in place of any monetary refund:

Plot-for-Plot Exchange: You may exchange your purchased property for another available plot of equal purchase price, subject to availability and any cemetery administrative approvals.
Granite Memorial Credit: The full amount paid may be applied toward the purchase of a granite memorial (headstone, monument, or bench) through Eternal Gardens Reserve or an affiliated memorial provider.

Exchange requests must be submitted in writing to info@eternalgardensreserve.com. The $500 deed transfer fee and any third-party fees already incurred (Stripe processing, notary, cemetery recording fees) are non-transferable. Exchanges are not available once a deed transfer has been recorded.

5. Installment Plans

Down payment is required to activate a plan; payments are tracked in your Digital Payment Book.
0% interest / Same-as-cash when paid in full within 18 months; 3.5% APR applies to any balance remaining after 18 months.
Deed transfer is scheduled only after the balance reaches $0.
Missed payments may result in plan cancellation; amounts already paid are subject to the Exchange Policy above (Section 4) and are not refundable in cash.

6. Deed Transfer

Deed transfer and/or internment rights are provided after full payment is received. Transfers are scheduled 5–7 days after final payment at the cemetery administration office. A valid photo ID is required.

7. Limitation of Liability

Eternal Gardens Reserve acts as a broker and concierge. We are not responsible for cemetery-maintained grounds, maintenance fees levied by the cemetery, or acts outside our control. Our total liability for any claim is limited to the amount paid for the specific service in dispute.

8. Governing Law

These Terms are governed by the laws of the State of Maryland. Any dispute will be resolved in a Maryland court of competent jurisdiction.
